Terms and Conditions

By accessing or using these Platform on any computer, mobile phone, tablet, console or other device (collectively, “Device”), you agree that you have read, understand and agree to be bound by these Terms and the applicable law, whether or not you are a registered member of FILA. We may change these Terms at any time without notice, effective upon its posting to the Platform. Your continued use of the Platform shall be considered your acceptance to the revised Terms. If you do not agree to these Terms, please do not use these Platform.
All intellectual property on the Platform (except for “User Generated Content”) is owned by FILA or its licensors, which includes materials protected by copyright, trademark, or patent laws. All trademarks, service marks and trade names are owned, registered and/or licensed by FILA. All content including, but not limited to text, software, scripts, code, designs, graphics, photos, sounds, music, videos, applications, interactive features and all other content (“Content”) on the Platform (except for User Generated Content), is a collective work under the copyright laws of Hong Kong and other countries and is the proprietary property of FILA, and is also protected by applicable copyright laws and treaties around the world. All such rights are reserved. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify FILA trademarks in any way, including in advertising or publicity pertaining to distribution of materials on the Platform, without our prior written consent. The use of FILA trademarks on any other website or network computer environment, for example the storage or reproduction of (a part of) the Platform in any external Internet site or the creation of links, hypertext or deeplinks between the Platform and any other Internet site, is prohibited without the express written consent of FILA.
Platform Use Restrictions
You may use the Content only for your own non-commercial use to participate in the Platform or to place an order or purchase FILA products. You agree not to change or delete any ownership notices from materials downloaded or printed from the Platform. You agree not to modify, copy, translate, broadcast, perform, display, distribute, frame, reproduce, republish, download, post, transmit or sell any Intellectual Property or Content appearing on the Platform, including User Generated Content (defined below), without FILA's prior written consent, unless it is your own User Generated Content that you legally post on the Platform. You agree not to use any data mining, robots, scraping or similar data gathering methods. Nothing in these Terms shall be interpreted as granting any license of intellectual property rights to you.
User Generated Content and User Account
1.Safeguard Your Username/Password
You are responsible for any actions that take place while using your FILA account. Keep your username/password secure and do not allow anyone else to use your username/password to access the Platforms. We are not responsible for any loss that results from the unauthorized use of your username/password, with or without your knowledge.
2.User Generated Content
"User Generated Content" refers to communications, materials, information, data, opinions, photos, profiles, messages, notes, website links, text information, music, videos, designs, graphics, sounds, and any other content that you and/or other Platforms users post or otherwise make available on or through the Platforms, except to the extent the Content is owned by FILA.
Posting Rules: User Generated Content and User Conduct
You are solely responsible for your User Generated Content, your interactions with other users and your activity on the Platforms. Do not take any action or post anything that may expose FILA or its users to any harm or liability of any type.
4.Be Relevant and Constructive.
You agree to stay on topic and post only constructive comments and questions. Unless the Platforms feature asks for it, you agree not to talk about policies, future products, speculations or rumors about FILA and FILA products, or anything else off topic.
5.Be Courteous and Appropriate.
Flaming and insults are prohibited. You agree not to post User Generated Content, or a link to a website, that, in FILA's sole discretion, is illegal, offensive, libellous, defamatory, infringing, inflammatory, deceptive, inaccurate, misleading, malicious, fraudulent, false, indecent, harmful, harassing, intimidating, threatening, hateful, abusive, vulgar, obscene, pornographic, violent, sexually explicit, invasive of privacy, publicity, intellectual property, proprietary or contractual rights, offensive in a sexual, racial, cultural, or ethnic context, will harm or threaten the safety of others, or is otherwise objectionable. You agree not to post photos or videos of another person without that person's consent. You agree not to “stalk”, intimidate, abuse, harm or harass another Platforms user or person.
You agree not to post personal information. You agree not to collect or solicit personal information from other Platforms users or send unsolicited emails or other communications. You agree not to collect, use or post on the Platforms the private information of anyone else without their consent or for illegal purposes.
The Platforms are not to be used for any commercial purpose without our approval. You agree not to post any advertising, solicitation or commercial content whatsoever on the Platforms or accept payment from a third party in exchange for your performing commercial activity on the Platforms. You agree not to post any User Generated Content that involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”. You agree not to use automated scripts to collect information from, or otherwise interact with, the Platforms.
You agree that you possess or control all rights in any User Generated Content that you post on the Platforms. You are responsible for ensuring that any User Generated Content that you post does not, and will not, infringe or violate anyone else's rights, including copyright, trademark, patent, trade secret, privacy, publicity or other personal or proprietary rights. You agree not to submit User Generated Content unless you are the owner or have permission from the owner to post such User Generated Content and grant FILA all of the license rights granted in these Terms.
You agree not to post any User Generated Content, take any action or use the Platforms in an unlawful manner or in a manner that would create liability or promote illegal activities. You agree not to take any action on the Platforms to interfere, disrupt, damage, disable, overburden or limit the functionality of any computer software or hardware, telecommunications equipment or the Platforms. You agree not to post User Generated Content that contains software viruses, programs or other computer code. You agree not to circumvent or modify any Platform security technology or software.
Terms of Sale
The Platform only sells Products to adults who have payment ability. If you are under 18 years, please use the Platform with participation of your parent or guardian.
A.Establishing an Account
In order to purchase Products/services from the Platform and in order to access/use some features on the Platform, you may be required to establish and use an account. However, you may only establish an account if you are 18 years of age or over. In addition to your name and contact information, you may be required to submit a valid credit card number, billing address, and related billing information in connection with your account. When you register for an account you must;
(i) provide accurate and truthful information, and
(ii) update such information from time to time as necessary to keep your registration information current and accurate.
B.Purchase of Products
Offer to Purchase
All information on the Platform is only an invitation to treat and is not an offer or unilateral contract. You agree that your order is an offer to purchase the Products listed in your order from FILA on these Terms and Conditions.
Promotional discounts are non-transferable and there is no cash alternative. Only one promotional code will be accepted per order. The terms and conditions may vary for each promotional code and we reserve the right not to accept, honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code or other similar promotions. We reserve the right to cancel an order in the event that an unauthorized promotional code has been used.
All prices are indicated and charged in Hong Kong dollars.

How to use a FILA promo code?
If you have a FILA promo code, you can enter it during the checkout process.
1. When entering your shopping cart page, simply find payment summary on the right and enter promo code in the “Enter a promo code” text box.
2. Click “Apply”
3. Should you confirm to redeem the promo code on this order, please press “Checkout” to complete the payment.
The discount will be reflected in the order summary if the code is accepted. If the code is not accepted, you will receive an on-screen notification. If you have entered the promo code, but do not receive any discount, review the ‘’FILA Promo Code Terms and Conditions” to ensure the code can be applied to the specific product(s) you are purchasing. A promo code may have a specific expiration date or be exclusive to certain products.
FILA Promo Code Terms and Conditions:
• Some promo codes are only applicable to specific promotions and only once, please refer to the individual promotion rule for details.
• For where a promo code could apply, it must be entered prior to submitting your order.
• Promo codes are not transferable or redeemable for cash or credit, nor can they be applied to the products of which you have made the payment.
• For those cash-deducting promo code, the total amount of your order must be higher than the promo code amount, the remaining amount of the transaction must be settled by other means of payment.
• There may be purchase limitation on the orders where a promo code apply, please refer to the individual promotion rule for details.
• Promo code are not applicable to all products and services from FILA, certain products and services are excluded as shown below.
• FILA Return and Exchange Policy applies to all products and services purchased with a promo code, but the consumer is only eligible for a refund of up to the actual payment. The promo code for one-off use cannot be reused after a purchased item is returned or refunded.
• If you cancel an unpaid order after entering the promo code, you will need to wait for 30 minutes to reactivate the promo code.
• Please pay attention to the expiry date of promo code. All promo codes shall be used for successfully placing an order at or before the expiry date. Otherwise, it would be deemed void.
FILA promo codes cannot be used for the following:
Special edition products and some selected products as listed or claimed in individual promotion, or with notification on exclusion.
Discounted items: If you want to use a promo code, discounted items shall be calculated on the original price, unless specified in the promotion. (If not specified in the promotion, the promo codes only apply to the original price of discounted item instead of the discounted price.)
Promo codes cannot be used in conjunction with other promotional offers or discounts, unless specified in the promotion.

Orders on the Platform and deliveries are possible only certain regions and area of a region. If FILA is not able to execute an order, FILA will inform you as quickly as possible.
Quantity Limits & no purchase for resale
Orders are accepted only in quantities usual for households. The Platform is intended solely for FILA to sell Products direct to end consumers, and therefore purchase of Products for resale is strictly prohibited. Purchase for resale means the purchase of Product by someone who resells, or intends to resell, the Product to others (consumers, businesses or any third party). If FILA believes you are involved in purchase for resale, FILA reserves the right to take any action against you, including, without limitation, to restrict your assess to or use of the Platform, restrict sales to you, cancel your orders, and/or suspend or close your account.
Confirmations and Acceptance
When you submit an order, we will send you an email acknowledging receipt of your order ("Order Confirmation"). This does not mean that we have accepted your order.
OUR ACCEPTANCE OF THE ORDER WILL NOT TAKE PLACE UNLESS AND UNTIL (I) WHEN THE PRODUCTS ARE SHIPPED TO YOU, AND (II) WE WILL SEND YOU AN EMAIL CONFIRMING THAT THE PRODUCTS HAVE BEEN SHIPPED ("SHIPPING CONFIRMATION").
Products on the Platform are in stock and are ready to be sent. Any sizes that are out of stock are marked as unavailable. We may have stock issues from customers ordering Products at the same time. When we are unable to ship an item already ordered, we may cancel that part of your order and you will be reimbursed or not charged accordingly. We work hard to keep our stock levels as accurate as possible. Occasionally, errors may occur. If the Products you are looking for are sold out, you may wish to check availability with your FILA store, through our Store Locator, or, as our stocks are regularly replenished, return to our online collection at another time.
If you have placed an order in error, or would like to cancel an order before it is delivered, please immediately contact FILA's customer service by e-mail us at: OfficialSite@fila.com.hk FILA will use its reasonable endeavours to consider your request to cancel such order and assist you in any way it can. No cancellation is possible after any Product under the order is shipped. As FILA always strives for quick deliveries, it means there is not much time available for you to cancel your order.
Please note that we cannot make or accept any changes (including delivery address, size, colour of the Products) once your order has been placed.
Right Not to Accept Orders
Fulfilment of all orders on the Platform is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel an order by written notice to you in the following situations (which list is not intended to be exhaustive), without being liable for any damages or costs other than repayment of any amount received from you in relation to the order we have cancelled:
1. The Product is not available;
2. Your billing information is not correct or not verifiable;
3. Your order is flagged up by our security systems as an unusual order or an order susceptible to or suspected of fraud;
4. We could not deliver to the address provided by you;
5. We believe you are under the age of 18 years old;
6. We believe that you are a reseller;
7. There was an error in the price display on the Platform;
8. In the event of misspelling, pricing or other errors or mistakes in the Platform information; or due to circumstances or events beyond our control.
The prices of the Products will be as displayed on the Platform. Prices may change from time to time, but changes will not affect any order which we have confirmed in the Order Confirmation.
Orders will be sent, via the Carrier, to the delivery address that you have given or selected, as the case may be, on your order form. We will not be responsible if that delivery address is incorrect or incomplete. Please note that there are restrictions on the locations to we deliver Products purchased from the Platform set out at Delivery Area:
Available delivery methods in case the delivery address is in Hong Kong:
(i) delivery to your residential address;
(ii) delivery to your nominated address
Available delivery methods in case the delivery address is in Macau:
Delivery to your nominated address;
When you have selected your preferred delivery method (provided that your order has been accepted by FILA), your order shall be processed and we will endeavour to dispatch your order in accordance with the estimated delivery times set out at “Shipping Methods & Timeline” , whichever is applicable, or as otherwise specified upon completion of order. Please note that the delivery dates specified in your order, the email confirming the order or on the “Shipping Methods & Timeline/ Macau Shipping Policy” are estimates only. We shall not be liable for any failure to deliver on any particular date. Estimated delivery times will be calculated from the date on which the order is processed, unless otherwise specified.
You agree that all Products ordered on the Platform shall be shipped by a Carrier and any claims for damages in delivery must be filed with the Carrier. There may be additional restrictions or exclusions in respect of Macau set out at “Shipping Methods & Timeline”. These may change from time to time. We shall endeavour to notify you of such restrictions.
The Carrier may request your contact details and other relevant information for delivery of the Products in accordance with relevant laws and regulations. You agree that your submission of such information is at your risk, and you hereby release FILA from any and all liability to you for any loss or liability relating to such information in any way.
Property in the Products you have ordered will pass to you under the following circumstances:
Property in the Products you have ordered will pass to you when you, or any third party on your behalf other than the Carrier, receive the Products;
Once the property in the Products have been passed to you all risk of damage to, or loss of, the Products shall pass to you. If you fail to take delivery or the Carrier is unable to deliver the Products, the risk in the Products will still pass to you, and we shall be entitled to charge you for any additional storage costs or delivery fees incurred by us.
Standard Delivery Time
Generally, delivery time is approximately 2 to 4 business days after the Product(s) under any order is shipped. Please note that we are unable to and we do not accept order to ship Products to PO boxes. The above delivery time is estimate only, and the exact delivery time will vary depending on region and district being selected. We do not ship on public holidays. For the purpose of these Terms and Conditions, "business days" mean any days which exclude Sundays and public holidays and any days on which a tropical cyclone warning signal no. 8 or above or a black rainstorm warning signal is issued in Hong Kong or bad weather warning of similar effect is issued in Macau at any time between 9:00 a.m. and 5:00 p.m.
If we fail to deliver the products within the estimate delivery time above, we will inform you and your sole and exclusive remedy is to choose either to wait for products to be delivered, or to cancel your order and get refunded. Apart from the foregoing, we will not make any compensation to you.
Acceptance of Products
Please check your ordered Product(s) (including complimentary gifts) in the presence of Carrier to confirm the quantity, type, color, size and intactness. Please accept the Product(s) only after the forgoing is confirmed by you. In case that you discover any shortfall, inconformity, obvious material or production defects or damage to the Product(s), please notify us immediately by email. Not doing so will not affect your legal rights.
D.Return /Exchange of Products
Return / exchange without quality issues
For Products purchased at the Platform, you can apply for a return / exchange within seven (7) calendar days from the date of receipt of the Products (based on the date of receipt on the logistics document). Unless there is product quality problem, all products are allowed to exchange ONCE only, and such exchange must be a product of the same style and in the same colour.
Please note that we only accept returns / exchanges if the returned / exchanged Products meet the "Return / Exchange Conditions" and do not belong to the "Return / Exchange Exclusions” described below. This return / exchange rule also applies to markdown items and promotional items.
Return / exchange with quality issues
For Products with quality problems purchased at the Platform, you can request a return / exchange within seven (7) calendar days from the date of purchase. It is our policy to satisfy the “Return / Exchange Conditions” described below and the quality problems are verified by our after-sales service centre.
1. Small threads, raw edges (commonly seen on apparel), colour differences due to different monitors (different displays, colour differences are not avoidable), thickness of the Products, running threads, hand-feel and other similar details, etc, are not recognised as quality issues.
2. Return / exchange due to reasons such as style, colour and subjective preferences are not a return / exchange for Products with quality issues.
3. Damage caused by improper use, wash or damage caused by your own alteration or other human factors will not be considered as a quality issue.
4. When selecting the size, please refer to the size chart and choose the size that suits you. The customer service team can only provide suggestions, not as the basis for your final purchase decision. If the Products you return / exchange due to size issue, it is not a return / exchange of Products with quality issue.
5. The size specifications of the Product shall be subject to the actual Product.
Return / Exchange conditions
1. the Products are sent back within the stated return / exchange period;
2. the Products are in original condition (for example, the Products are kept intact, unused, unwashed or unaltered, no stains or cosmetics on the products) and the conditions for re-sale of the Product has not been affected;
3. the outer package of the Product is intact (including the plastic bag or box; please do not stick any tapes or labels directly on our shoe boxes, please put the shoe box into another box or bag), the Product accessories, instructions, tags, labels, etc. should all be kept intact;
4. If the Product / parcel has additional gifts (gift with purchase promotion), please return the gift together. The gift needs to be kept in the condition as it was received. If the gift cannot be returned, we have the right to ask you to pay for the gift according to the price of the gift we have indicated.
Return / Exchange Exclusions:
1. Products not sold through the Platform, i.e. FILA Hong Kong Official Site;
2. customized products without quality problems;
3. underwear, socks, swimwear and selected limited edition products without quality problems;
4. where the Product is used, washed, processed (e.g. altered size), soiled or damaged, the logo is cut, and other merchandise not in re-sale condition;
5. where the electronic invoice or order number issued at the time of purchase is lost;
6. orders that exceed the return / exchange period;
7. other circumstances in which the consumer has no right to return / exchange according to this policy and the applicable law.
Please also note that you may process returns / exchanges online only for purchases made on the Platform. You cannot return / exchange Products purchased on our Platform at our FILA physical stores, and vice versa.
Return / Exchange process
Please refer to the Help Centre or contact our customer service for specific return / exchange procedures, which shall form part and parcel of these Terms and Conditions. When returning the Product please indicate the reason for the return in the delivery note for timely processing. If the delivery note is lost, please prepare a blank sheet of paper and fill in your name, order number, item number, quantity and reason. You also need to indicate the item number, colour, size and other information related to the returned / exchanged Product(s).
The newly exchanged item will be sent to the delivery address on the original order; if there is any change in the delivery address, please let our customer service know in advance. If you request to exchange the products, your return request cannot be accepted before the exchange is completed. If you have requested an exchange for any of the products in the order, you cannot request for further exchange in the same order until the existing exchange process is completed.
Return / Exchange delivery and postage instructions
Please note that we only accept returns / exchanges by delivery with traceable mailing, non-traceable delivery will not be accepted. For return / exchange without quality issues, the cost of postage is borne by you.
We recommend that you insure your package for safe return to us, and you are requested to declare the full value of the shipment to the courier company so that you are completely protected if shipment is lost or damaged in transit. If you choose not to insure or declare the full value of the returned / exchanged Products, you will be responsible for any loss or damage to the Products during shipping. We are not responsible for any risk of damage to, or loss of the Products upon return.
For the returned Products, once we confirm that the return conditions and requirements are met, we will refund the actual payment within 10-15 business days after receiving the returned Product(s), (The actual date when the money is credited to your account shall be subject to the business processing cycle of the bank), but:
1. We have the right to deduct the partial refund amount if your returned Products were bought together with other Products to enjoy our threshold promotions or offers;
2. We have the rights to deduct the shipping fee from your refund amount if your returned Products were bought together with other merchandise to enjoy a free shipping promotion.
The time of receipt of the refund depends on different refund methods. The time of actual refund to your account depends on different banks or payment platform operations.
If the return does not meet the return conditions or requirements, we will contact you and return the Product(s) to you at your cost.
Disclaimer of Warranties
The Platform and any products or services made available through the Platform are provided to you "as is" without any warranties of any kind, whether express, implied or statutory. You agree that you must evaluate, and that you bear all risks associated with, the use of the Platform, including without limitation, any reliance on the accuracy, completeness or usefulness of any materials available through the Platform. FILA and its suppliers and service providers disclaim all warranties with respect to the Platform and any product or service (including without limitation, third party products and services) obtained through the Platform, to the fullest extent permissible under applicable law, including the warranties of merchantability, fitness for a particular purpose, noninfringement, and title.
Limitation of liability
Neither FILA nor any of its suppliers, or service providers will be liable for any indirect, incidental, consequential, special, exemplary or punitive damages of any kind, under any contract, negligence, strict liability or other theory, including without limitation, damages for loss of profits, use, data, loss of other intangibles, loss of security of information you have provided in connection with your use of the Platform, or unauthorized interception of any applicable information by third parties, even if advised in advance of applicable damages or losses. In particular, and without limitation, neither FILA nor its suppliers, or service providers will be liable for damages of any kind resulting from your use of or inability to use the Platform or from any content posted on the Platform by FILA or any third party unless such damage is the result of any wilful misconduct on the part of FILA. Your sole and exclusive remedy for dissatisfaction with the Platform is to stop using the Platform.
While we try to maintain the integrity and security of the Platform and the servers from which the Platform is operated, we do not guarantee that the Platform will be or remain secure, complete or correct, or that access to the Platform will be uninterrupted. The Platform may include inaccuracies, errors and materials that violate or conflict with these Terms and Conditions. Additionally, third parties may make unauthorized alterations to the Platform. If you become aware of any unauthorized third party alteration to the Platform, contact us at OfficialSite@fila.com.hk with a description of the material(s) at issue and the URL or location on the Platform where applicable material(s) appear.
Some jurisdictions do not allow the limitation or exclusion of certain warranties, or the exclusion or limitation of certain damages. If you reside in one of these jurisdictions, the relevant limitations or exclusions may not apply to you.
FILA reserves the right to suspend or terminate your account (and delete the profile corresponding to such account and any accompanying content) or your use of this Platform at any time, for any reason or for no reason. We reserve the right to change, suspend, or discontinue all or any aspect of this Platform, Products and services available on or through the Platform at any time without notice. You are personally liable for any orders that you place or charges that you incur or are made under your account prior to termination. We shall not be liable to you or any third party for any of the foregoing.
Any sections of these Terms and Conditions that must survive termination in order to give effect to their intent and meaning shall survive termination of these Terms and Conditions. The termination of your account shall not affect any rights of FILA or any liabilities and obligations of you accrued prior to such termination.

Changes to these Terms and Conditions
If FILA decides to change these Terms and Conditions, we will post the changed terms and conditions on the Platform. You are advised to regularly check whether they have changed.
IF YOU CONTINUE TO USE THE PLATEFORM AFTER EFFECTIVENESS OF THE CHANGED TERMS AND CONDITIONS, YOU ARE DEEMED TO HAVE FULLY ACCEPTED THE CHANGES.
Governing Law and Jurisdiction
These Terms and Conditions (including all policies referred to herein) are governed by the laws of Hong Kong.
Any dispute arising from or relating to these Terms and Conditions (or any policy referred to herein) shall be subject to the exclusive jurisdiction of the competent Hong Kong court.
These Terms and Conditions do not, and shall not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and FILA.
If any provision of these Terms and Conditions is found to be unlawful, void or for any reason unenforceable, such provision will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of any remaining provision.
You may not assign, transfer or sublicense any or all of your rights or obligations under these Terms and Conditions without our express prior written consent.
We will not be responsible for failures to fulfil any obligations under these Terms and Conditions due to causes beyond our reasonable control, including but not limited to war, terrorist attack, strike, fire, explosion, flood, earthquake or other natural disaster.
These Terms and Conditions, together with all policies referred to herein, constitute the entire agreement between you and FILA relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements or understandings between you and FILA relating to the subject matter herein.
If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
Third Party Rights
No person shall have any right under the Contracts (Rights of Third Parties) Ordinance (Cap 623, Laws of Hong Kong) to enforce or enjoy the benefit of any of these Terms and Conditions.
